A number of social and legal options can be considered if the girl is willing but parents are refusing the marriage
There have been many cases where two individuals want to marry, but the girl’s family is opposed to the relationship and their marriage. This can be a difficult time for the girl and boy, their families and social groups. It is important to handle such situations with care and avoid any hasty steps that can leave scars for life. When a girl’s parents are opposed to marriage, here are some options that can be considered.
Communicate and negotiate – If communication channels are open, it is recommended to use this option. It is important to understand why the girl’s parents are opposing the marriage. It could be due to various factors such as the financial status of the boy, cultural mismatch, caste differences, etc. Elders in the family or community leaders who have more experience in such matters can be involved in the discussions. The boy must be willing to make changes in accordance with family traditions and cultural ethos.
Seek support from relatives – Many times, the parents’ opposition to their girl’s marriage could be due to the inability to understand the full context of the situation. In such cases, the girl’s relatives such as siblings or cousins can be engaged to provide a more holistic view of the marriage proposal. Involvement of more modern ways of thinking and interpreting relationships can present the situation in a favorable manner.
Legal options when girl’s parents refuse marriage – This approach can be used when all other means of communications have been exhausted.
Arya Samaj marriage – This is a simple way to get married, applicable in case of same-religion (Hindu) couples. Only the basic documents are required such as age and identity proof. The marriage is completed in a day. Marriages under the Arya Samaj are recognized under the Hindu Marriage Act 1955, ensuring legal sanctity of the marriage.
Court marriage – This option can also be utilized with basic documents such as birth certificate, Aadhar and address proof.
Private marriage – In some cases, the couple (both legally adults) can marry in private and get the marriage registered at a later date. In such cases, it is recommended to get legal advice and guidance to avoid legal complications in the future.
Getting help
If the couple is facing threats, police protection can be sought from the court. A police case under Section 506 of the IPC (criminal intimidation) can be filed. The boy can also approach the high court to file a habeas corpus petition. This ensures that the girl is not being kept confined in her home forcibly against her will. One can also approach the National Commission for Women (NCW) to get help in such matters.
